If you are a tenant and you have a defective apartment or home and the landlord refuses to fix it, you may be able to withhold rent to force the landlord to fix the problems, or to give you some power to negotiate a termination of the Lease Agreement. You have to read your Lease Agreement very carefully to see if you have this right, and you also have to read Florida Statues section 83.51 to see if you have this right. WARNING: Law is complex, and if you do this wrong, you could be sued and lose money and the home or apartment you are living in. Please be aware of the requirement that you deliver the notice at least 7 days before the start of the next pay period.
